Disney would freak out……

If they saw a character actor take off the head in view of the public - not to mention smoking.

Disney character actors are absolutely never allowed to break character or mess up the illusion.

Since he is not a Disney employee using their characters for monetary gain, I expect Disney would send him a cease and desist letter instead.

They don't even break character backstage (out of public view) except in narrowly defined breaking dressing areas. :) I remember meeting a Minnie actor several times in cafeteria lines, I knew she played Minnie onstage only by her stockings and shoes. :)

Current artists and creators will be able to make use of Mickey, but with major limits. It is only the more mischievous, rat-like, non-speaking boat captain in “Steamboat Willie” that has become public.

“More modern versions of Mickey will remain unaffected by the expiration of the Steamboat Willie copyright, and Mickey will continue to play a leading role as a global ambassador for the Walt Disney Company in our storytelling, theme park attractions, and merchandise,” Disney’s statement said

Not Sure That'll Work for Them...

Depends, apparently, on whether the character's a complete departure from previous depictions of him. (Sherlock Holmes in later stories wasn't different enough from Study in Scarlet. Mickey likely meets that criterion -- but I'm not sure Minnie would.)
