Dorothy, it is well that you worry about your mother. But the one who drove the car owes your mother for any damages to her car.

That sounds about right

Agreed. The driver is responsible, but I believe the insurance company is primarily responsible. If the insurance company balks and the damage is substantial it is worth it to at least talk to a lawyer, with most of them the first visit is free. If anyone is hurt it is definitely worth looking into, as that is real bucks.

If I read this right?

...it's not the one thing that happened, but that it's just one more thing. It's not about insurance or cars or even your Mom, but about feeling overwhelmed. Just take a deep breath and realize that you're okay. Yes, it's one more thing, but it's also one more thing to get through; proving your heart and your faith are much stronger than you ever imagined when you started taking steps to be who you are.

Auto coverage

He may be covered as a temp driver, depending how often he drove the car. If he drove it everyday of the year from work then they won't cover him because he should've been added to the policy as a second driver.

Coverage

RAMI

Dear Dorothy:

From your various posts, and comments, I am confuses as to where you live. No matter what she, your mom MUST contact her insurance company and perhaps a lawyer.

In the U.S. auto coverage and liability questions differ greatly from one state to another. The differences can be so great, that understanding the law and coverage in one state, might mean you know nothing in the next state.

Injury and damages depend on many factors. Injury to property, medical bills, injury to driver, injury to passenger, collision damage, injury to other drivers, etc.

Since I think you are in Canada, (I sorry if I'm wrong) things are totally different. Depending what province you are in Quebec vs most of the rest of Canada, the difference could be huge.

She should Get proper legal advice. She should call your insurance broker.. Call an attorney. Be careful what you say to the adjustor.

two things: first: it's you

two things:

first:
it's you mom's -car- that has been damaged, not your mom herself.
it'll sort itself out, one way or another.

second:
no matter if he was covered by you mom's insurance or not, the driver is liable for any damages he caused. that goes for your mom's damages to her car as well as those of other damaged parties. (if he's responsible for the accident that is. "getting into an accident" doesn't necessarily mean he caused it.)
the big question here is if he can and will pay for it.
and most insurances will pay the damage, then collect the money from the responsible party.
