Some time ago there was a blog post here about a Quebec author, Yvan Godbout, who was charged with creating child pornography because his dark retelling of Hansel and Gretel included a rape scene.
The trial has now been completed and M. Godbout has been acquitted of all charges. The judge in the case also ruled that ruled that certain articles of Canada's child pornography laws cast too wide a net, targeting works of literature that don't endorse or promote pedophilia.

I'm against most of those
I'm against most of those various laws, in the US and Canada. Mostly because they ban things like Lolita (which is just a _name_, people), as well as make sex offenders out of people that have baby pictures, or photos of their vacation at a nude beach.
I'll get a life when it's proven and substantiated to be better than what I'm currently experiencing.
No Pictures, no Rapes.
Not that I know for sure, but I had thought that in the US, if a story does not include Pictures it can not be child porn. I may be wrong. I don't publish stories about Rape or Sexual Intercourse in anything but the most oblique terms. I was Raped as a teen so it can be quite triggering. There are authors here who will not write about preadolescents.
