I just read through the text

I just read through the text of the bill - it's not very long - and nowhere in there does it require the schools contact parents.

To me, what I'm seeing is that if a parent approaches the school for information, they would be required to hand over all information about the child, much like requesting a copy of all doctor's notes from your family doctor before you move to a new location. A kicker is that the bill talks about this, unless subject to section 38.004, which is an anti-child abuse section.

I don't think this amendment would fly, however. It's too easy to challenge, because if the school has a licensed psychiatrist/psychologist on hand, their notes would be bound by the normal privilege, and this attempts to bypass that.

So, the sites reporting on it _are_ scaremongering. It will not be 'outing' kids by the school calling parents. The only 'outing' would be if the parents _ask_ and the school has it in their records. Most parents won't be bothered.

I don't quite understand how schools can withhold information from parents/legal guardians in the first place. But as I don't live in the USA there may be many things I don't know and/or understand ...

Well, every state's different

Well, every state's different. I suspect that if the school feels that the information is proprietary, or 'in the best interests of the child', they'll happily with-hold information. Frankly, I don't think that most parents ask for more than what schools would normally give out. Grades, schedule, and punishments.

Personally I read these fear mongering articles very carefully before making any comments on them or discussing them with anyone else.

Why is it everyone seems to think that racists and hate groups can just create legislation out of nowhere? Unless someone votes a member of the KKK into a congressional office, either state or federal, the "Hate Group" won't be creating legislation. What's even more crazy is that people keep thinking that who the President is will suddenly cause massive upheavals in the legislation being created BY THE EXISTING LEGISLATURE.

Please, stop with the fairy tales and the sky falling. THINK!

Remember how legislation is created. The legislation mentioned in this article was created as a proposal by ONE WOMAN. It then has to be accepted by a majority of the 150 member House and 31 member Senate, then be signed into law by the Governor (one of his two jobs).

If you see something like this, point it out to someone like me - who lives in the state. I can call my state rep's office, or email, or show up at their door, and ask them to oppose it if I feel it's a bad idea. If you're living in Minnesota, why are you so freaked out about it? You can't do anything about it, other than talk to YOUR state representative and point it out as a bad idea for them to do in your state. I'll admit I get upset at California legislation, but that's because that stupid state has managed to decide what is written on the packaging of almost everything I can buy here. "This product contains chemicals known to the state of California to cause cancer, rickets, heart disease, palsy, dropsy, and flying monkeys to fly out of your ass." Either it causes cancer or it doesn't. They should not be allowed to dictate packaging from companies out of the state without discussing it with the FTC. (and in this case, the FDA. Either it causes cancer, or it doesn't. There's nothing magical about the air in California that would make it special there.)

Oh, and if you wonder why the price of eggs is still higher than it was before the avian plague - blame California. They forced farms across the country to change their production lines if they did business with anyone in California.

So, please, next time someone says the legislation is EEEEEVIL, read it, and decide if it's something you can do anything about. As I posted, I pulled down the legislation and put it in context with what it wants to amend, and while it is likely to fail (due to the psych section - violation of doctor/patient privilege), it's nothing like the articles were claiming.

Oh - personal opinion? I'm glad the bigots are crawling out of the woodwork. I'm all for that. It's easier to avoid them that way. I've always hated most of the 'reverse racism' laws we have on the books. I'd rather deal with people honestly, not with them having to lie because they'll end up in jail if they own up to what they really think.

Interpretation of Law

It may seem that the law doesn't hurt our children and it may be an innocuous looking piece of legislation, but it is how courts can interpret the law that can be harmful. The US has a history of passing laws without thinking about how they would be interpreted and it winds up biting them in the backside. Look at the law with a devious mind and you can see how it can be misused.
