Just a Normal Girl 3

Yeah. I was out of school for a few days. Had to go back to Ohio for the trial.

Back before I got into Whateley, and I was still living with the mess back home, I got arrested after someone called the cops when I used the women's restroom at a restaurant.

Another shining example of tolerance and sensibility, that.

It was months ago, but the trial only came up now. Our lawyer figured there'd be some arguing. He was going to challenge the whole premise of the "man in a women's bathroom" bit.

Only it all went out the window when the prosecutor put the woman who'd made the complaint on the stand. I just stared at her when she said that she'd seen my penis through the gap in the stall door.

My attorney just let her dig herself deeper then when it was time to cross-examine, he asked her to repeat what she'd said.

Then asked why she hadn't been charged as a peeping tom. While the prosecutor and judge were spluttering, he picked up a folder from the evidence he'd had ready to submit.

Then he said she couldn't actually be guilty of being a peeping tom, anyway because she was obviously lying. Which made her guilty of perjury.

The woman yelled that she wasn't lying. The prosecutor was objecting as well. And the judge didn't look very happy.

That's when he slid the folder in front of the judge and asked to have it admitted as evidence.

It was a report from several doctors explaining my "condition" in detail. And as he put it "My client does not now have a penis nor has she ever had one."

The stupid bitch actually yelled something about how he was lying, that she'd heard all the news about how I was a boy pretending to be a girl before the prosecutor could shut her up.

There was a lot of arguing, and our lawyer had to call up the doctors who'd written the reports. They even had to threaten to produce photos and let them have doctors examine me.

That last was when they tried to claim I'd had sex change surgery.

They wanted to drop it then, but our lawyer told them he'd still be filing suit for false arrest and suing the lady. As well as forcing them to file perjury charges against her.

They tried keep a disturbing the peace charge but we pointed out I was minding my own business. And that there was no way it'd have caused less fuss if I'd gone into the men's room.

We wound up with the charges dismissed, but the judge weaseled out of ruling that I could use women's bathrooms and other facilities. He didn't say anything about my having to use men's one's though.

Since they didn't find me guilty of anything, we can't appeal. So we've still got to wait on the case about my sex under state law.

Some people...

Why can't some people just mind their own buisness? Does that give them a warm fuzzi feeling to make trouble?
I guess intollerance breeds intollerance and with the whole anti-mutant nazi thing that is going on in the whateley 'verse they're probably even worse agains all other "deviants".
I wonder what kind of adventures she'll have at whateley... But with her luck she'll probably end up in a wheelchair or worse.

Ridiculous

This is so ridiculous that it's funny. I somehow doubt that this would happen, even in the Whateley Universe. But I am enjoying it and look forward to see where it goes next.

Alas, it's based off a real

Alas, it's based off a real incident.

A local T-girl got hassled by mall security after some woman reported her for using the women's bathroom. And she indeed use the "I saw his penis" bit. Though in this case, it's possible that she did.

When the mall security idiots called the cops, the cops basically gave them a "Why are you wasting our time?"

Y'see, here in Portland (and Multnomah county) it's been perfectly legal for folks even *attempting* to look female to use the women's restroom. Ditto for the "changing rooms" at clothing stores. They do draw the line at locker rooms though.

It's been that way for more than 10 years (probably 15). And state law has been that way for at least 5 years.

The same sort of thing happened to the same t-girl at another mall. I guess she may not pass that well.

I still say that the woman who claimed she could see the t-girl's penis should have been held by mall security as a peeping tom. But given that they weren't aware of a long standing law covering the matter...

Twenty years ago

Something very like this happened to a woman body builder in Orange County. She was arrested and even brutalized by the cops for using the women's restroom. She was not trans, had never been other than female, she simply had muscular arms and neck because she was in a body building competition that very week in Anaheim.

That case was part of the impetus that got the law clarified in California. It could still happen in many parts of the country.

Sad Ignorance

The problem is I can see this happening. That is so very sad. She is being forced to prove a negative when in our court system you're supposed to be innocent until proven guilty. Given some of the asses at Whateley, she'll be lucky to get out of there without ending up in body bag. Intolerance and hate breeds more of the same. I'm looking at you Nex. We can always hope that Dr. Dad drops in to say hello while she and are family are away, I guess. Not that would solve the problem, but it sure would feel good.

That's a problem of all

That's a problem of all human law systems/constitutions. The law is only as strong as the support of the people. Every "democratic" constitution can support a tyranny, if the bureaucracy reads the laws that way.
You just need to change the definition of human, or even citizen and a democracy becomes a tyranny.

That's why liberal principles say that something can't be a democracy if a group is discrimminated for their being the way they are. Well, or at least democracy is at doubts.
Democracy can't be a dictatorship of majority, but a system where nobody is excluded or discriminated.

That stuff like this is possible should ring the alarm bells of every liberal in the nation.

Actually, democracy is a *bad* thing. Check your history. That's why the founding fathers in the USA made a point of *not* making the country a democracy, but instead tried to create a republic with democratic features.

*Every* true democracy has wound up as a tyranny of the majority.

This btw, is why I get so pissed off when groups with an axe to grind talk about how horrible it is that judges will rule a law passed by the people as being unconstitutional.

Sorry, but the constitution *does* trump simple majority votes of the population and it was *designed* that way on purpose.

Folks forget that the laws against the Jews in German were voted on in many cases. If not by the population, by their representatives. and if they'd been subject to a vote of the people, they'd have still passed.

Later stuff grew out of that.

In any case "voting" on a groups rights is almost allways a really bad idea.

Actually, she'll be pretty safe at Whateley in that regard. It's probably common knowledge that gender flipping can happen when the metagene activates, and although there are bigots on campus, everyone generally follows the rule of if it's in a girl's uniform, it's a girl; if it's in a boy's uniform, it's a boy; and if it's wearing half 'n' half, it's Ayla :) The uniform keying also helps with some of the more extreme cases, whereby if they weren't wearing the uniform it would be difficult to identify what species they were, let alone what gender.

Besides which, although Poe is officially where the nutcases live, they do tend to stick up for each other. And you really don't want to get them angry, especially as even the smallest and officially weakest member of the dorm could cause you serious harm courtesy of her "devises". And that's before she got the Regen-5 upgrade.

This Is So Stupid

That educated people could respond this way is beyond me; however, I think I answered my own question. Women and girls with CAIS or near CAIS are virtually indistinguishable from genetic women until there is an internal or chomosomal examination. Several famous actresses and women in society are believed to have near complete AIS. Unless there is a DNA analysis, we'll never know for sure. Besides, it's none of our business.
