Angie Zapata was an 18 year old MtF pre-op TS who was killed by her 'boyfriend', beaten to death by him, supposedly when he 'discovered that she was a he. The'boyfriend' claimed that when he 'suddenly' found out that Angie wasn't what she seemed, he panicked, and beat her to death, probably to soothe his offended 'macho pride.'

" But prosecutor Brandi Nieto argued that Andrade learned the truth about Zapata's gender 36 hours before he killed her. Andrade had accompanied Zapata to traffic court, where clerks called her Justin Zapata, Nieto said.
"This was not a snap decision," she said. "
And since the KILLER is going to be taking the Stand in his defense, all the Proscution has to ask is IF he had gone with ANGIE ZAPATA to Traffic Court and his defense is totally SHOT down the drain. All the Proscution has to do is have the Traffic Court Clerks say that Yes, this man was with her at her Traffic court.
This KILLER deserves to DIE! pure and simple. There is NO way he can possibly win his case. Not with so much evidance against his "claim" of being "shocked" that Angie Zapata was "biologically male"
> Today a Weld County jury heard two starkly different views of the last days of Angie Zapata's life.á‚ But both sides agreed that Angie Zapata was violently murdered -- and the defendant Allen Andrade is the person who beat Angie to death.
> Allen Ray Andrade of Thornton has been charged with first-degree murder after deliberation, a bias-motivated crime, felony motor vehicle theft and felony identity theft in Angie's killing last July in Greeley.
> In opening statements, the prosecution said they will present evidence that shows that Andrade knew that Angie was transgender long before he killed her.
> Prosecuting attorneys said in the days leading up to the two meeting in person, they had exchanged nearly 700 communications.
> After meeting, the two went to a traffic court hearing in Greeley in which Angie was identified in court by her previous male name and by male pronouns.á‚
> The defense team contends Andrade did not learn of Angie's transgender status until moments before he killed her.
> Angie's family was allowed to hear opening statements, but many were asked to leave after those statements as they are also witnesses later in the trial.
> "What we were reminded of today is that Angie was someone's daughter, a loving sister, and had many friends," said Kelly Costello, director of Advocacy for the Colorado Anti-Violence Program.á‚ "We were also reminded that someone else chose to end Angie's life because of his own anti-transgender bias.á‚ This is a difficult time for family.á‚ Seeing Angie's lifeless body and hearing about the last days of her life were very difficult for people who loved Angie."

> THE ANGIE ZAPATA MURDER:
> VIOLENCE AGAINST TRANSGENDER PEOPLE
> Introduction
> On April 14, 2009, the two-week trial for the murder of Angie Zapata"an 18-year-old transgender woman"is scheduled to begin in Greeley, Colo. Angie's trial will mark the first time an anti-transgender murder will be prosecuted as a hate crime under state law in this country. Due to this landmark case's complexities and its significance for LGBT people, it is of utmost importance that media coverage of the tragic death of Angie Zapata be inclusive, accurate, and respectful of a community that is too often targeted for harassment and violence.
>
> Angie Zapata was brutally murdered in an attack motivated by anti-transgender bias on July 17, 2008. Allen Ray Andrade, 31, has admitted to police that he and Angie met online, that they went on a date, and that he viciously beat her to death.
>
> According to the National Coalition of Anti-Violence Programs (NCAVP), the total number of victims reporting anti-LGBT violence increased by 24 percent from 2006 to 2007. The number of anti-LGBT murders also doubled during that time period. Despite this, federal hate crimes laws do not include sexual orientation and gender identity.
>
> By looking back on Angie Zapata's death and the countless other incidents of tragic violence that occur every year due to anti-LGBT bias, the media can play a vital role in determining future community and law enforcement response to hate-motivated attacks from local and state hate crimes legislation to the Matthew Shepard Act and beyond.
> The Bombshell Dropped In Prosecutor's Opening Statement At The Angie Zapata Hate Crime Murder Trial

Today, 8:00AM to 5:00PM-ish MDT, I was in the Weld County, Colorado courtroom where the Angie Zapata Murder. The prosecution dropped a bombshell in the afternoon's opening statements: Jury Hears Opening Statements in Hate Crime Trial. The Gay, Lesbian, Bisexual, And Transgender Community Center Of Colorado -- in an understated way -- states the courtroom revelation:
In opening statements, the prosecution said they will present evidence that shows that Andrade knew that Angie was transgender long before he killed her.
Prosecuting attorneys said in the days leading up to the two meeting in person, they had exchanged nearly 700 communications. After meeting, the two went to a traffic court hearing in Greeley in which Angie was identified in court by her previous male name and by male pronouns.
The defense team contends Andrade did not learn of Angie's transgender status until moments before he killed her.
>
> What came out in court, per Deputy District Attorney Brandi Lynn Nieto, was this traffic court trip took place 36-hours before Allen Ray Andrade admittedly killed her.
>
> As the prosecution is describing the timeline, a trans panic or gay panic strategy would, with the evidence that the prosecution has stated in court it will present, be impossible to support. And, that's because a trans panic/gay panic defense is a crime of passion strategy: If, as suggested, Allen Ray Andrade knew Angie was transgender 36-hours before he killed her, then this wasn't a crime of passion.
>
> And, since the defense is using a classic gay panic/trans panic/blame- the-victim strategy -- the defense using the hated language of "deceptive" to describe Angie in their opening statement, and using the language of "supposedly female" to describe Angie in questions posed to witnesses in cross-examination later in the day -- and if the prosecution uses can adequately support their opening statement assertions in their presentation to the jurors, then this alleged 36-hour awareness of her transgender status would destroy the veracity of the defense assertions.
>
> This really is a bombshell dropped by the prosecution team!

How *despicable*
This guy deserves the *worst* that can happen to him. The hate murder is disgusting enough, but his defense is pure insult. "I overreacted"? Bullshit. He deserves to rot in some dark corner for a long, long time.

The Prosecution will come out on top
One thing I know about Law is that its based on logic. I am sure from what I've read that the prosecution has all of its ducks in a row. The Marcia Clark defense strategy failed with OJ. When they have evidence that the killer was in traffic court and knew then that his "girlfriend" was transgendered he did not seem to be concerned. If he was thent he killing would have taken place at traffic court.
Defense attorneys are paid to find loopholes to get theri client off. It seems to me the Greely Colorado District Attorney has provided no loopholes.
As far as the killer rotting in jail, I think the dealth penalty will suffice. he had time to plan the murder, plan his defense and then commit the murder, then say it was a crime of passion he certainly was in a dreamworld.
I don't think we would last in general population.

Tranny murder as a misdemeanor
Well, Jill, I'd love to agree with you, but what about the cases where the people were convicted of assault or something lesser? I am not flaming you, I am just complaining about how we get treated.
I notice that this case is getting lots of national attention. In fact CNN is carrying it live at the moment. Can it be that someone is trying to help us? GAWD, I can't breathe!
